As a member of the European Union (EU), the European legislation on genetically modified organisms (GMOs), which has been in place since the early 1990s, is either directly applicable in Germany or has been implemented into German law. The European Commission (EC) has created a comprehensive legal framework and introduced specific legislation on GMOs. Therefore, the comprehensive information given in the report of the EU also partly covers the situation in Germany. Germany has fully implemented existing EU legislation into national law through the German Gentechnikgesetz (Genetic Engineering Act and its Regulations, BCH-LAW-DE-39280-7) and the EG-Gentechnik-Durchführungsgesetz (EC Genetic Engineering Implementation Act, BCH-LAW-DE-40590-6). These legal documents are publicly available on the Biosafety Clearing-House (https://bch.cbd.int/en/countries/DE) as well as the homepage of the German Competent National Authority (Federal Office of Consumer Protection and Food Safety, BVL) which also hosts the German BCH homepage: https://www.bvl.bund.de/DE/Arbeitsbereiche/06_Gentechnik/gentechnik_node.html and http://www.biosafety-bch.de. In addition to European legislation German law foresees administrative fines and penalties to ensure compliance with relevant provisions. The Articles 38 and 39 of the German Genetic Engineering Act as well as the §§ 6 and 7 of the German EC Genetic Engineering Implementation Act include penal provisions that serve to enforce the aims and provisions of the Cartagena Protocol. These provisions penalize actions that can contravene the goals of the Cartagena Protocol, for example the deliberate release of a GMO into the environment or the placing on the market of a GMO without the necessary authorization. Moreover, § 6, 2nd paragraph of the German EC Genetic Engineering Implementation Act penalizes the transboundary movement of GMOs carried out in contravention of the relevant German and European laws. Biosafety is also integrated in the German Nationale Strategie zur Biologischen Vielfalt 2030 (National strategy for biological diversity 2030). Goal 20.5 aims at the implementation of the Cartagena Protocol until 2030 and beyond (https://www.bundesumweltministerium.de/download/die-nationale-strategie-zur-biologischen-vielfalt-2030-nbs-2030). The EU has developed a comprehensive legal framework on GMOs, which also addresses the import of GMOs intended for direct use for food or feed, or for processing. The EU has declared, with reference to Article 14.4 of the Cartagena Protocol that it relies on its existing legal framework for intentional movements of GMOs within the EU and for imports of GMOs into the EU.

Regulation (EC) No. 1946/2003 and other relevant EU regulations are implemented into national laws where appropriate, e.g. EG-Gentechnik-Durchführungsgesetz (EC Genetic Engineering Implementation Act, BCH-LAW-DE-40590-6). Regarding question 88: In Germany, controls on genetically engineered organisms (GMOs) are not performed by customs. Samples are taken at various entry-points (ports, airports) by staff from the responsible control facility. Therefore, there is no need for customs officers to be trained in the identification of GMOs. Regarding question 92 a): Currently, all official GMO control laboratories in Germany have access to certified reference materials (CRM) for GMOs that are authorised within the EU. This is not ensured regarding any GMO unauthorised in the EU. However, due to the low number of providers for CRMs worldwide, access might not be reliable in the future. Independent production of CRMs might challenge individual laboratories. Regarding question 94: German laboratories are well-equipped for both, detection and identification of GMOs. However, while GMOs authorised in the EU can be identified, as a specific method for each GMO is mandatory to be provided with the application documents, this does not mean that any GMO can be identified. Regarding question 95: Germany’s reply can only reliably refer to the official GMO control laboratories of the Federal States and the National Reference Laboratory. There are also private certified laboratories.

As outlined in the report of the EC, there are several activities at EU level to strengthen harmonisation of the processes under the Protocol. German experts are involved in respective activities and bodies. Furthermore, on a national level, in the current reporting period, Germany conducted one capacity-building activity in cooperation with the Secretariat of the CBD: Germany organised and hosted the “International Conference on GMO Analysis and New Genomic Techniques” in March 2023. The Federal Ministry of Agriculture, Food and Regional Identity provided 80.000 Euro to enable government employees working in the field of detection and identification of LMOs from Parties in need for support to attend this conference. Moreover, a German expert in risk assessment and risk management of LMOs working at the Federal Office of Consumer Protection and Food Safety participated as an expert and resource person in the “International training course on risk assessments of living modified organisms" in June 2025 in Brazil.
